Understanding Australia's(OHLA)
Overview
- The On-Hire Labour Agreement (OHLA) is an agreement between the Australian Government and approved labour hire providers, enabling Australian businesses to access suitably skilled overseas workers where genuine local shortages exist. Under this arrangement, workers remain employees of the labour hire provider while performing work for the host employer.

Eligibility
- Businesses can engage workers only for approved occupations and must demonstrate a genuine business need that cannot be readily met through the local labour market.
- Compliance: Adhering to the agreement's requirements and treating sponsored workers fairly is crucial.
Worker Requirements
Workers must:
- Meet visa and skill requirements
- Receive at least the Temporary Skilled Migration Income Threshold (TSMIT) or applicable market salary
- Be employed under Australian workplace laws
- Receive the same workplace protections as Australian employees

Labour hire providers must maintain ongoing compliance with immigration, Fair Work, taxation, superannuation and workplace safety requirements. Host employers must also provide a safe workplace and comply with workplace obligations.

Schedule of Rates
Charge Rates:
- Ordinary Time: Charge rate for each hour of ordinary time worked.
- Overtime: Charge rates for overtime hours, typically structured as follows:

- Allowances: Charge rates for applicable allowances paid to employees in various circumstances, including:
Meal allowance
Crib allowance
Travel allowance
Laundry allowance
Industry-specific allowances (e.g., additional hourly rate for working with wet/dirty hanging birds in the poultry sector)
Classification Levels:
Charge rates for physical hours (ordinary and overtime) are typically quoted at discrete classification increments, such as Level 1, Level 2, etc.
Minimum Shift Requirement:
All labour hire assignments, whether temporary or ongoing, are subject to a minimum of four (4) hour shifts per day, in accordance with Fair Work Australia requirements.
